MOBILE MULLIGANS GOLF™
PARTICIPANT RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK & TERMS

READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.

 

By entering the Mobile Mulligans Golf™ truck, simulator bay, or designated activation area, or by participating in any activity operated by Mobile Mulligans LLC (“MMG”), you (“Participant”) acknowledge and agree to the following:

ASSUMPTION OF RISK

Participation in a mobile golf simulator experience involves inherent and unpredictable risks. These risks include, but are not limited to:

 

  • Slips, trips, or falls while entering, exiting, or moving within or around the truck

  • Being struck by golf balls, golf clubs, or other equipment

  • Equipment malfunction, electrical issues, or power interruption

  • Contact with structural elements, screens, curtains, or barriers

  • Weather-related conditions including wind, rain, heat, or lightning

  • Actions of other participants, including negligent or reckless conduct

  • Vehicle movement, leveling systems, or mechanical components

  • Serious injury, illness, property damage, or, in rare circumstances, death

 

Participant understands that these risks may arise from their own actions, the actions of others, environmental conditions, or the negligence of MMG to the fullest extent permitted by law.

 

Participant voluntarily assumes all such risks.

RELEASE OF LIABILITY

To the fullest extent permitted by law, Participant releases, waives, and discharges Mobile Mulligans LLC, Mobile Mulligans Golf™, and their owners, officers, employees, contractors, agents, affiliates, sponsors, and representatives from any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to participation in MMG activities.

 

This release includes claims based on negligence.

INDEMNIFICATION

Participant agrees to defend, indemnify, and hold harmless MMG from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses, including attorney’s fees, arising out of or related to:

​

  • Participant’s actions or conduct

  • Injuries caused by Participant to other individuals

  • Damage to equipment or property caused by Participant

  • Claims brought by third parties arising from Participant’s participation

​

This indemnification obligation applies even if MMG is alleged to have been negligent, except in cases of gross negligence or willful misconduct.

PARTICIPANT CONDUCT & SAFETY RULES

Safety rules are strictly enforced. Failure to comply may result in immediate removal without refund.

 

  • One golfer in the simulator bay at a time

  • All shots must be hit from the designated striking area

  • All shots must be aimed at the impact screen

  • No intentional mis-hits

  • No trick shots, running swings, or “Happy Gilmore” swings

  • No club throwing

  • No leaning or hanging on structural elements

  • No food, drinks, gum, or sticky items inside the simulator bay

  • No lob wedges or high-lofted clubs (maximum club permitted: pitching wedge)

  • Appropriate footwear required

  • Follow all verbal and written instructions from MMG staff

 

MMG reserves the right to refuse participation to any individual for safety reasons.

 

EQUIPMENT & PROPERTY DAMAGE

Participant is financially responsible for any damage to MMG equipment, vehicle, or property caused by misuse, negligence, reckless behavior, or failure to follow instructions.

 

Financial responsibility may include:

 

  • Full repair or replacement cost

  • Lost revenue while equipment is out of service

  • Administrative and legal fees

 

MINORS

Minors may participate only with the consent and supervision of a parent or legal guardian.

By permitting a minor to participate, the parent or legal guardian:

​

  • Represents that they have legal authority to consent

  • Agrees to this Release on behalf of the minor

  • Accepts full responsibility for the minor’s participation

​

For open-access or walk-up events where individual signatures are impractical, parental consent may be established by the parent or guardian’s presence, supervision, and voluntary allowance of participation after reasonable notice of these terms.

MEDIA RELEASE

By entering the MMG truck or participating in MMG activities, Participant grants MMG the unrestricted and irrevocable right to photograph, film, and record Participant in any media format. Participant authorizes the use of such media for promotional, marketing, and commercial purposes, in perpetuity, without compensation. If Participant does not wish to be recorded, they must notify MMG staff before participation.

SEVERABILITY

If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

GOVERNING LAW, ARBITRATION & CLASS ACTION WAIVER

This Agreement is governed by the laws of the State of Indiana.

 

Any dispute, claim, or controversy arising out of or relating to participation in MMG activities shall be resolved exclusively through binding arbitration administered by the American Arbitration Association in Marion County, Indiana.

 

Participant waives the right to a jury trial and agrees not to participate in any class action, collective action, or representative proceeding against MMG.

 

ACKNOWLEDGMENT

By entering the MMG truck or participating in any MMG activity, Participant acknowledges that they have read, understood, and agree to be bound by this Participant Release, Waiver of Liability, Assumption of Risk & Terms.

 

Participation constitutes acceptance of these terms.
